Terms of sale
PREAMBLE
The general terms and conditions of sale of MEDIA EXPLORATION, consisting of this Preamble and the clauses that follow it, are entered into between, on the one hand, MEDIA EXPLORATION, as described in the "Legal Notice" document, and, on the other hand, the Customer, meaning the person who places an order for a product offered for sale via the website "www.theadventurepost.co" (the "Site").
The Legal Notice and all prices available on the Site apply to sales contracts concluded via the Site between MEDIA EXPLORATION and the Customer. No other contractual provision arising from documents sent or provided by the Customer may be incorporated into these terms. Only MEDIA EXPLORATION's express acceptance of any such document shall be binding on it.
"Customer" here means a consumer, a non-professional, or a professional meeting the conditions set out in Article L221-3 of the French Consumer Code. Only these three categories benefit from specific rights, notably those set out in the French Consumer Code.
Conversely, where the Products as defined below are purchased via the Site by a professional who does not meet the conditions of the aforementioned Article L221-3, the Customer acknowledges that these specific rights shall not apply to them.
The Customer declares that they have the legal capacity to enter into contracts.
Visitors wishing to place an order via the Site must check that the law applicable to them allows them to carry out this type of transaction. Deliveries are only made to the countries listed on the Site. The existence of the Site cannot be considered as solicitation, and the contract concluded between the Customer and MEDIA EXPLORATION is a distance contract.
1 – PURPOSE
These general terms and conditions of sale (the "Terms") set out the conditions under which any purchase of one or more Products presented on the Site and defined in Article 2 below is made, whether through a one-off purchase or by subscribing to a subscription (the "Subscription").
2 – PRESENTATION OF THE PRODUCTS ON THE SITE
MEDIA EXPLORATION publishes and distributes educational publications in the form of handwritten letters designed to stimulate learning, cultural openness and the development of reading and writing skills (the "Products"). The Products offered for sale are those shown on the Site on the day the order is placed (Article 3 of the Terms). Information about the Products can be accessed by clicking on the Product photograph or next to the Product. While not exhaustive, this information is intended to inform you as fully as possible of the essential characteristics of the Product.
The Product delivered may sometimes differ slightly from its presentation on the Site. Such differences cannot be interpreted as a lack of conformity or lead to the cancellation of the sale, except where they concern an essential characteristic of the Product and affect its quality.
3 – ORDERS
The Customer may order Products or subscribe to the Subscription only via the Site and in English.
3.1 – Customer identification
The Customer may place an order via the Site without having to log in beforehand. After placing an order, the Customer may open an account to manage their Subscription. To do so, the Customer must provide their contact details and create login credentials consisting of their email address and a password of their choice. The Customer may log back in later using this information. They may also change their password in the "My account" tab. This password is strictly personal and must be kept confidential. The Customer expressly acknowledges that entering their email address and password constitutes identification on their part.
3.2 – Conclusion of the order – double click
3.2.1. One-off purchases of Products (excluding Subscriptions)
The sales contract is validly formed when, having entered their email address and password, the Customer has placed their order for Products (first click), has been able to read and accept the Terms, has checked the content of their order (all the Products they wish to purchase), has corrected any errors and has confirmed it with a second click, in accordance with Articles 1125 to 1127-3 of the French Civil Code.
The double-click procedure constitutes the Customer's consent and makes the sums due for the performance of the order by MEDIA EXPLORATION payable.
In accordance with Article L221-14 of the French Consumer Code, any order confirmed by the second click entails an obligation to pay.
3.2.2. Subscriptions
The Customer may take out a monthly Subscription with MEDIA EXPLORATION for a fixed term of 3, 6 or 12 months.
For a Subscription, the sales contract (successive sales) is validly formed when, once identified, the Customer has selected the Subscription terms (type of subscription, duration) (first click), has been able to read and accept the Terms, has checked the content of their order (Subscription terms and price), has corrected any errors and has confirmed it with a second click, in accordance with Articles 1125 and 1127-3 of the French Civil Code.
The double-click procedure constitutes the Customer's consent and makes the sums due for the performance of the order by MEDIA EXPLORATION payable.
In accordance with Article L221-14 of the French Consumer Code, any order confirmed by the second click entails an obligation to pay. The order is confirmed upon the first payment.
At the end of the initial period, the Subscription renews automatically for the same duration as initially contracted, provided the Customer has selected this option in their account and has not objected to the renewal, after notification from MEDIA EXPLORATION, within the time limits set.
A Customer who has taken out a Subscription may not request its termination, except in the event of moving to a territory not served by MEDIA EXPLORATION's deliveries, after notifying MEDIA EXPLORATION by email at hello@theadventurepost.co and providing valid proof.
3.3 – Confirmation of the sales contract
An email including the Terms will be sent to the Customer's email address to confirm the conclusion of the contract on a durable medium. This confirmation email will also include the order number and will set out all the information covered by the general duty to inform referred to in Articles L221-5 and L221-11 et seq. of the French Consumer Code.
The Customer is therefore strongly advised to keep this acknowledgement email.
3.4 – Performance of the order – Product availability
MEDIA EXPLORATION undertakes to use its best efforts to fulfil orders, but can only perform this obligation within the limits of available stock.
In the event of a stock shortage, MEDIA EXPLORATION will inform the Customer as soon as possible and make the Product unavailable for sale.
Products are available as long as they are visible on the Site. Should a Product become unavailable after the order has been placed, the Customer will be informed immediately by email. The order will be automatically cancelled and no payment will be taken.
3.5 – Proof of transaction
The computerised records kept in MEDIA EXPLORATION's computer systems under reasonable security conditions shall be deemed proof of the communications, orders and payments between the Parties. Order forms and invoices are archived on a reliable and durable medium that may be produced as evidence, which the Customer expressly acknowledges.
4 – PRICING
4.1 – Currency – Taxes
Prices shown on the Site are expressed in the currency displayed at the time of the order, inclusive of applicable taxes. The tax rate applied is the legal rate in force on the date of the transaction. In the event of a change in the applicable tax rate, prices including tax will be adjusted immediately, without prior notice.
In the event of a manifest and gross typographical error in the displayed price, the sale may be cancelled by MEDIA EXPLORATION or by the Customer.
4.2 – Price changes
MEDIA EXPLORATION may change the prices of its Products at any time. However, such changes shall not apply to orders validly placed and in progress (Article 3.2).
4.3 – Delivery and handling fees
In addition to the price of the Product, the Customer must pay delivery fees, which vary in particular according to the geographical area concerned, the delivery method chosen and the volume and weight of the parcel, as well as any handling fees shown before the Customer confirms the order, in the basket summary (second click).
4.4 – Promotional codes
Any promotional codes provided to Customers may only be used once for the same postal address and the same first and last name.
5 – PAYMENT
5.1 – Full payment of the order price must be made by bank card at the time of the order. Receipt of payment by MEDIA EXPLORATION triggers the preparation of the order and then its dispatch.
Any payment made by the Customer before delivery shall be considered neither as a deposit nor as a down payment.
5.2 – The Customer expressly acknowledges that providing their bank card number to MEDIA EXPLORATION constitutes authorisation to debit their account up to the total amount of the Products ordered or of the Subscription. The order amount will be debited at the time of the order.
The Site uses one of the most efficient state-of-the-art security systems and SSL (Secure Socket Layer) encryption. Only the bank holds the confidential information (card number, expiry date), which is inaccessible to any third party. If the bank refuses the payment, the Customer will be informed by email and the order will be automatically cancelled.
5.3 – The Customer guarantees to MEDIA EXPLORATION that they have the necessary authorisations to use the payment method chosen when confirming the order. MEDIA EXPLORATION reserves the right to suspend any order processing and any delivery in the event of refusal of authorisation for a card payment by officially accredited bodies, or in the event of non-payment.
MEDIA EXPLORATION reserves the right to refuse to make a delivery or to fulfil an order from a Customer who has not fully paid for the current order or partially paid for a previous order, or with whom a dispute is being handled.
5.4 – MEDIA EXPLORATION reserves the right to implement an order verification procedure to ensure that no one uses another person's bank details without their knowledge. As part of this verification, the Customer may be asked to send MEDIA EXPLORATION, by email or by post, a copy of an identity document and a copy of the bank card used for payment (front and back copy, showing only the first 4 and last 2 digits of the number on the front, and hiding the security code and the full card number that may appear embossed on the back). The order will only be confirmed after receipt and verification of any documents sent.
5.5 – Retention of title clause
MEDIA EXPLORATION retains ownership of the Products sold until full payment of the price, principal and incidental costs. Failure to pay, even partially, may result in the Products being reclaimed.
6 – DELIVERY
6.1 – Delivery method
MEDIA EXPLORATION cannot be held liable in the event of an incomplete or incorrect address, refusal of the parcel by the recipient without good reason, or any other lack of information regarding the delivery location.
Likewise, if the recipient is absent, MEDIA EXPLORATION cannot be held liable for any damage the Customer may claim.
In the event of an incorrect delivery address, problems accessing the delivery location, or any other problem requiring a new delivery, the new delivery may be invoiced at actual cost, it being understood that only payment of these additional costs will allow the new delivery.
6.2 – Countries delivered
Details of the countries delivered are available on the Site.
Customs duties or other local taxes, import duties or state taxes may be payable. They shall be borne by you and are your sole responsibility, both in terms of declarations and of payments to the competent authorities and/or bodies in your country.
6.3 – Delivery times
6.3.1 – Delivery times only start from the date of full payment of the order. They are expressed in working days and are, in principle, specified at the time of the order. In general, delivery within the stated time limits can only take place if the Customer has fulfilled all their contractual obligations towards MEDIA EXPLORATION.
In accordance with Article L216-1 of the French Consumer Code, and unless otherwise specified by MEDIA EXPLORATION at the time of the order, the delivery time for Products will be a maximum of three weeks from the date of full payment, with respect to the Customer. For a Subscription, this time limit applies to the first issue.
6.3.2 – If this time limit is not met, the Customer may require MEDIA EXPLORATION to perform within a new time limit. The formal notice must be sent by registered letter with acknowledgement of receipt to the following address: MEDIA EXPLORATION – 1 rue de Stockholm, 75008 Paris, France. If the order is not performed within this new time limit, the contract may be terminated by written notice sent in the same manner.
6.4 – In the event of termination of the sales contract under the above conditions, MEDIA EXPLORATION undertakes to refund the Customer all sums paid within 14 days of the termination of the sales contract.
6.5 – Missing Product or delivery not matching the order
If the Customer notices that a Product is missing upon delivery by the carrier, or that the parcel does not match the order (damage, damaged parcel, damaged products, etc.), they must contact MEDIA EXPLORATION by email at hello@theadventurepost.co within 48 working hours of delivery, stating their order number.
Where a Product is missing, MEDIA EXPLORATION will deliver it as soon as possible, at no additional shipping cost.
In the event of a delivery not matching the order, MEDIA EXPLORATION will replace the Product or, failing that, refund it in accordance with the procedure described in Articles 8 and 9 below.
7 – RIGHT OF WITHDRAWAL AND HOW TO EXERCISE IT
7.1 – Time limit
The Customer has 14 calendar days (excluding Saturdays, Sundays and public holidays) from the day after receipt of the Product by themselves or by a third party designated by them (Article 6.3), or from receipt of the first Product in the case of a Subscription, to exercise their right of withdrawal, in accordance with Article L221-18 of the French Consumer Code.
7.2 – How to exercise this right
The Customer may exercise this right using the withdrawal form provided at the end of the Terms, or by sending an email clearly stating their wish to withdraw to hello@theadventurepost.co. MEDIA EXPLORATION will acknowledge receipt of the withdrawal by email to the address provided by the Customer.
7.3 – Return costs
This right of withdrawal is exercised without penalty. Return costs are borne by the buyer.
7.4 – Return conditions
The Product must be returned in its original packaging, so that it can be offered for sale again as a new product, within a maximum of 14 days of notifying MEDIA EXPLORATION of the withdrawal decision. The Customer will place inside the parcel the return form provided by MEDIA EXPLORATION, duly completed with the appropriate reason for return.
Only Products returned in their entirety and covered by the withdrawal will be accepted.
However, the transport packaging (shipping box) may be changed if it is not essential to the packaging and therefore to resale.
Any Product that has been opened or damaged, or that is no longer fit for resale, will not be refunded.
7.5 – Refund
MEDIA EXPLORATION undertakes to refund the order for the Products concerned, including the standard delivery fee, using the same payment method as for the original transaction, unless otherwise expressly instructed by the Customer. The refund is scheduled upon receipt of the Product, in perfect resaleable condition as specified above, at the address indicated by MEDIA EXPLORATION. The refund may be brought forward upon presentation of proof of shipment of the entire Product.
8 – REFUND POLICY (LEGAL WARRANTY)
8.1 – Non-conforming or defective products
All Products sold benefit from the statutory provisions on the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code) and from the legal warranty of conformity (Articles L217-4 to L217-13 of the French Consumer Code). The warranty applies upon presentation of the purchase invoice. Defects or damage caused by natural ageing, by improper use, or by any modification not provided for or specified by MEDIA EXPLORATION and/or the manufacturer are excluded from the warranty.
The legal warranty does not apply where the damage is due to a cause external to the Product (accident, impact, etc.) or to the Customer, such as failure to comply with the Product's conditions of use.
8.2 – Warranty claims and returns
To make a warranty claim, the Customer must send an email to MEDIA EXPLORATION at hello@theadventurepost.co, clearly stating their wish to invoke the warranty and specifying the order number. MEDIA EXPLORATION will acknowledge receipt by email to the address provided by the Customer. The Product must be shipped with the return label provided by MEDIA EXPLORATION stuck on the parcel, and with the return form provided by MEDIA EXPLORATION, duly completed with the appropriate reason for return, placed inside the parcel.
9 – RETURN COSTS
The return costs incurred by the Customer for a warranty claim, as well as reshipping costs, are borne by MEDIA EXPLORATION.
However, where the warranty is not recognised, MEDIA EXPLORATION reserves the right to invoice the Customer for the reshipping costs. In this case, the cost of the return will have been communicated to the Customer beforehand.
10 – LIABILITY
10.1. MEDIA EXPLORATION is automatically liable for the proper performance of the order.
However, any improper performance or non-performance due to a cause attributable to the Customer, to force majeure as defined by Article 1218 of the French Civil Code, or to an unforeseeable and insurmountable act of a third party to the contract may exonerate MEDIA EXPLORATION from all or part of its liability.
10.2. Suspension – account termination
MEDIA EXPLORATION reserves the right to suspend or terminate the account of a Customer who breaches the provisions of the Terms or, more generally, the applicable legal provisions, without prejudice to any damages MEDIA EXPLORATION may claim.
Any person whose account has been suspended or closed may not subsequently place an order or create a new account on the Site without the prior express authorisation of MEDIA EXPLORATION.
11 – ARCHIVING – PROOF
The computerised records, kept under reasonable security conditions, shall be deemed proof of the communications, orders and payments between the parties.
Order forms, order confirmations and invoices are archived on a reliable and durable medium, so as to constitute a faithful and durable copy.
MEDIA EXPLORATION's computerised records shall be considered by the parties as proof of the communications, orders, payments and transactions between the parties.
The Customer may access the archived documents on simple request to hello@theadventurepost.co.
12 – PERSONAL DATA
In the course of performing the order, MEDIA EXPLORATION collects personal data. To find out more: https://theadventurepost.co/policies/privacy-policy
13 – MISCELLANEOUS
Generally, the Customer and MEDIA EXPLORATION expressly accept that they may exchange information by email, including the exchange of consents.
MEDIA EXPLORATION's correspondence address is hello@theadventurepost.co.
MEDIA EXPLORATION may amend the Terms at any time in order to incorporate, on the one hand, any legislative or case-law change applicable in particular to e-commerce and, on the other hand, any technical or technological development improving the Site.
If any provision of these Terms is held to be void, it shall be deemed unwritten, but shall not render the other contractual provisions void.
Any tolerance or waiver by either party in applying all or part of the commitments made under these Terms, whatever its frequency and duration, shall not constitute an amendment of the Terms or create any right whatsoever.
14 – DISPUTE RESOLUTION
These Terms are governed by French law.
In the event of a dispute, the Customer who is a consumer, a non-professional, or a professional meeting the conditions set out in Article L221-3 of the French Consumer Code will first seek a solution directly with MEDIA EXPLORATION. If no satisfactory solution is found, the Customer may submit the dispute free of charge to a mediator, in accordance with Articles L.611-1 et seq. and R.612-1 et seq. of the French Consumer Code.
